Toxic Substances
We represent a variety of individuals in disputes that arise over toxic substances and environmental contamination, including claims against landowners, responsible manufacturers and sellers of products and materials that cause asbestosis,
mesothelioma, silicosis and
lead poisoning. We also handle claims for injuries related to welding rod fume exposure.
We also represent employees of private companies as well as governmental entities and municipalities for claims of work-related toxic exposures that result in personal injuries. Exposure to silica on the job can lead to serious, even fatal, lung disease that results in a claim for damages on the part of an injured employee and his or her family. We have extensive experience with these claims, which can involve a complex coordination of workers compensation benefits and product liability and are often brought in the form of class action or mass group litigation.
Exposure to lead-based paint used in industry, on equipment or in playgrounds and parks is another common source of claims. Although lead-based paint is the most common source of lead poisoning, other sources can also contribute to the problem. For example, dangerous levels of lead have been found in vinyl and plastic blinds and other decorating fixtures (such as bath tubs) manufactured in countries other than the United States. As with claims related to silica, claims for damages related to lead exposure are also commonly brought as a mass tort.
We have pursued claims against large companies and individuals in cases involving exposure to lead, asbestos, welding rod fumes, silica and toxic chemicals. We have the resources to handle class action litigation and multi-party claims of all types. Our attorneys are familiar with the insurance coverage issues, as well as extra-contractual issues, that arise in handling toxic tort and environmental claims.
